Varak: Foil Invitation Maker — Terms of Use

Varak is a card design app for iOS (iPhone and iPad) offered by Cihat SALIK ("we," "us," or "our"). It designs foil-stamped cards — invitations, save-the-dates, greeting cards and business cards — renders their foil in real time, and exports them as MP4 shimmer video, stills, and PDF/X-4 print files with foil spot plates. Part of the App is free to use; the rest is unlocked by Varak Pro. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Three projects, the full editor and Foil Studio, the templates and motifs that are not marked Pro, watermark-free stills at screen size, and 1080p video at 30 fps carrying a small "Made with Varak" end card. There is no account and no time limit.

3.2 Plans

• Monthly: an auto-renewable subscription.

• Yearly: an auto-renewable subscription, with any free trial period shown before purchase.

• Lifetime: a non-consumable one-time purchase. Paid once, it is not a subscription — nothing renews and nothing is billed again.

Any of them removes the project limit and the end card, and adds 4K and 60 fps video, the PDF/X-4 print export, the holographic and onyx foil family, and the brand kit. The exact contents of each plan are described in the App and on its App Store product page and may change as the App develops.

3.3 Billing and Renewal (subscriptions only)

• A subscription renews automatically at the end of each period unless you cancel before the end of the current period.

• Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.4 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Varak and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. To request a refund, use Apple's "Report a Problem" or the refund flow in the App Store. We do not control Apple's refund decisions.

3.5 Restoring and Access After Pro Ends

The lifetime purchase is non-consumable, so you can restore it on your other devices signed in with the same Apple ID using Restore Purchases. When a subscription expires or is cancelled, access to the unlocked features ends at the end of the paid period and the App returns to its free tier. Your existing cards and prior exports are not deleted and remain openable; new exports made after that point follow the free tier's limits.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.

• Infringe or misuse the intellectual property or other rights of us or any third party. You are responsible for holding the rights to any photo, logo, artwork or typeface content you place in a card, and for how you use, publish, print or sell the card that results.

• Transmit harmful, offensive, or illegal content, or use the App to harass or harm others.

• Reverse-engineer, decompile, or attempt to extract source code of the App (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your cards: You keep ownership of the pictures, text and cards you create in the App. We claim no rights in them and need no license to them, because they stay on your device. Cards you design may be printed, shared and sold, including commercially, subject to your holding the rights to what you placed in them.

On-device operation: Varak reads only the photos you pick through the system picker, and designs, renders, preflights and exports your work on-device. We do not require an account, and the App contains no networking code: it sends nothing to us or to any third party. Version 1.0 stores your library on the device only; iCloud sync is not enabled.

Motion: The device's motion sensors are read so the foil reacts as you tilt the card. The readings light the current frame and are then discarded; they are not stored or transmitted.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/varak/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, foil engine, templates, motifs, text, graphics, and the "Varak" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

The templates and motifs bundled with the App may be used in cards you design, print, share and sell. They may not be extracted, redistributed or resold as design assets in their own right.

The bundled typefaces are third-party families licensed under the SIL Open Font License; their names and the licence text are listed in the App under Settings → About. Those families belong to their own authors, and using them in a card does not make the card's design theirs.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

The foil render is a simulation of how light falls on stamped metal leaf. What a printer actually produces depends on their press, the die, the stock and the foil they hold; colour on screen is not a proof. Preflight's warnings — minimum feature size, foil at the trim, foil and paper too close in luminance — are calculated guidance about what a foil die can do, not a guarantee of the printed result. Confirm specification and colour with your printer before you commit to a run.

We are not responsible for any loss of content (for example, cards or exports) due to device failure, user action, or other causes. You are responsible for backing up your work as you see fit, for example by exporting a .varak project package.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it. This includes the cost of any print run.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App (including features and purchase offerings) from time to time. Where the law requires, we will notify you of material changes to the service or subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/varak/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in Section 3.4.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchases or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
