Tezhip: Gold Mandala Art — Terms of Use

Tezhip is a drawing application for iOS (iPhone and iPad) offered by Cihat SALIK ("we," "us," or "our"). It is a studio for Ottoman illumination: gold brushes whose strokes are shaded as real metal and respond to the device's orientation, gold motifs, mandala and wallpaper symmetry, ebru marbling, cut-reed calligraphy, and export as stills, wallpapers, Live Photos and shimmer videos. Part of the App is free to use; the rest is unlocked by Tezhip Pro. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Drawing itself: every Ebru, calligraphy and inking brush, the Tezhip Gold set in the burnished finish, layers, undo and still wallpapers up to 4K. No account is required and there is no time limit on the free tier.

3.2 Plans

• Weekly: an auto-renewable subscription, with a 3-day free trial shown before purchase.

• Yearly: an auto-renewable subscription.

• Lifetime: a non-consumable one-time purchase. Paid once, it is not a subscription — nothing renews and nothing is billed again.

Any of them opens every gold motif, all six finishes, shimmering Live Photo wallpapers, shimmer videos, 8K export and the full symmetry catalogue. The exact contents of each plan are described in the App and on its App Store product page and may change as the App develops.

3.3 Billing and Renewal (subscriptions only)

• A subscription renews automatically at the end of each period unless you cancel before the end of the current period.

• Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.4 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Tezhip and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. Use Apple's "Report a Problem" page or the refund flow in the App Store. We do not control Apple's refund decisions.

3.5 Restore and Access After Pro Ends

The lifetime purchase is non-consumable and can be restored on your other devices signed in with the same Apple ID using Restore Purchases. When a subscription expires or is cancelled, access to the unlocked features ends at the close of the paid period and the App returns to the free tier. Your existing drawings and earlier exports are not deleted and remain openable; new exports made from that point are subject to the free tier's limits.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.

• Infringe or misuse the intellectual property or other rights of us or any third party. You are responsible for holding the rights to any image you bring into a drawing, and for how you use, publish, print or sell the result.

• Transmit harmful, offensive, or illegal content, or use the App to harass or harm others.

• Reverse-engineer, decompile, or attempt to extract source code of the App (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your artwork: You keep ownership of everything you draw in the App, and you are free to use, publish, print and sell it. We claim no rights in your drawings and we do not need a license to them, because they stay on your device.

On-device operation: Drawings, layers, undo history, gold shading and every export are created and stored on your device. Tezhip asks for add-only access to Photos so it can save what you export; it cannot read your library. Any image you bring into a drawing is one you pick through Apple's system picker.

Motion: The device's motion sensors are read so the gold responds as you tilt. The readings light the current frame and are then discarded; they are not stored or transmitted.

Diagnostics: On first launch only, the App sends a single anonymous message reporting your device model and name, iOS version, screen, hardware, locale, time zone and app version. Nothing about your artwork, photos or usage is included, and nothing further is sent afterwards.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/tezhip/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, shaders, brush engine, text, graphics, and the "Tezhip" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

The brushes, gold motifs, finishes and patterns shipped with the App may be used freely inside the artwork you draw, print, share and sell. They may not be extracted, redistributed or resold as design assets in their own right.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

The gold rendering is a simulation of how light falls on beaten metal leaf. What it looks like on your screen depends on your display and on the lighting around you, and a printed or gilded reproduction will not match it exactly.

We are not responsible for any loss of content (for example, drawings or exports) due to device failure, user action, or other causes. You are responsible for backing up your content as you see fit, for example by exporting to Photos or Files.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App from time to time, including its features and purchase options. Where required by law, we will notify you of material changes to the service or to subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/tezhip/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in 3.4.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchase or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
