Stretch: Piano Tuner Pro — Terms of Use

Stretch is an electronic tuning device for pianos, offered for iOS (iPhone and iPad) by Cihat SALIK ("we," "us," or "our"). It measures a piano's inharmonicity through the microphone, calculates a stretched tuning for all 88 keys, guides the tuning key by key, and keeps a file and a report for each instrument. Part of the App is free to use; the rest is unlocked by Home Plus or by Pro. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Checking a piano's tuning across the whole keyboard, touching up notes between C3 and C6, equal temperament and an A4 reference between 392 and 466 Hz. No account is required and there is no time limit on the free tier.

3.2 Home Plus

Home Plus is a non-consumable in-app purchase. It is paid once and is not a subscription; nothing renews and nothing is billed again. It opens tuning across all 88 keys, the unison helper and the historical temperaments. It supports Family Sharing.

3.3 Pro

Pro is offered two ways: as a non-consumable one-time unlock you keep, or as an auto-renewable annual subscription with a 14-day free trial shown before purchase. Either opens measured stretch from your own inharmonicity readings, the pitch-raise workflow, client files, before and after PDF reports and the Apple Watch display. The exact contents of each tier are described in the App and on its App Store product page and may change as the App develops.

3.4 Billing and Renewal (subscription only)

• The annual subscription renews automatically at the end of each period unless you cancel before the end of the current period.

• Payment is charged to your Apple Account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.5 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Stretch and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. Use Apple's "Report a Problem" page or the refund flow in the App Store. We do not control Apple's refund decisions.

3.6 Restore and Access After Pro Ends

A one-time purchase can be restored on your other devices signed in with the same Apple Account using Restore Purchases. When the annual subscription expires or is cancelled, access to the Pro features ends at the close of the paid period and the App returns to the tier you have bought outright. Your pianos, measurements, sessions and reports are not deleted and remain readable; what ends is the ability to take new measured-stretch and pitch-raise sessions.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.

• Infringe or misuse the intellectual property or other rights of us or any third party.

• Breach the data protection obligations you owe to your own clients when you store their details in the App.

• Transmit harmful, offensive, or illegal content, or use the App to harass or harm others.

• Reverse-engineer, decompile, or attempt to extract source code of the App or its measurement and tuning algorithms (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your content: You keep all rights in the pianos, measurements, notes and reports you create in the App. We claim no rights in them and we do not need a licence to them, because they stay on your device.

On-device operation: The microphone signal is analysed in real time and discarded; only the derived numbers are kept. Measurements, curves, sessions, client files and reports are stored on your device, and every calculation runs there.

iCloud: With sync on, your data moves between your own devices through Apple's private CloudKit database. We operate no server and have no access to it. Turn sync off and the store is local only.

Your clients' data: If you enter a client's name, address or other details, you are the one deciding to collect that data and you remain responsible for it under the law that applies where you work. We never receive it.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/stretch/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, signal processing, tuning and inharmonicity models, temperament definitions, report layouts, text, graphics, and the "Stretch" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

Reports you generate for your own clients are yours to send, print and keep.

The App is a measuring and guidance tool, not a technician. Tuning, pitch raising and any repair work on a piano are physical operations carried out by you on an instrument that can be damaged by them. Strings can break and pins, plates and soundboards can be stressed, particularly during a large pitch raise.

You decide what to do to an instrument, and you remain responsible for that decision and for the condition of the piano. Where the App warns you that a job exceeds what a touch-up can safely do, that warning is a floor, not a guarantee: a reading within limits is not a promise that a particular piano can take the work. If you are not trained to tune, have the instrument seen by a qualified technician.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

Measurement depends on your room and your instrument. Background noise, a weak strike, a badly placed device, a worn string or a damped partial will lower the confidence of a reading and can produce a poor fit. The App shows confidence and input level so you can judge this; it cannot guarantee the accuracy of any single reading.

The calculated tuning is a target. Aural judgement, the behaviour of the instrument and your own technique all sit between that target and the finished tuning.

We are not responsible for any loss of content (for example, pianos, measurements, notes or reports) due to device failure, user action, or other causes. You are responsible for backing up what matters to you.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it, including any damage to an instrument.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App, its in-app purchases and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App from time to time, including its features and purchase options. Where required by law, we will notify you of material changes to the service or to subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/stretch/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in 3.5.

Features already unlocked by a one-time purchase remain unlocked; we will not move a previously purchased feature behind a new payment.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchase or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
