Paper Marbling Art – Ebru — Terms of Use

Ebru is a creative application for iOS (and where available, other Apple platforms) that lets you create digital art inspired by the traditional art of ebru (water and paint). You can create, save, and manage your artwork within the App. Some features are available to all users; advanced features (including saving artwork to your device's Photos library and other "Ebru Pro" features) are available through a paid subscription called Ebru Pro.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 Plans

• Ebru Pro Monthly: Billed monthly. Gives access to Ebru Pro features for one month from the purchase date.

• Ebru Pro Yearly: Billed annually. Gives access to Ebru Pro features for one year from the purchase date and is offered as a better value for long-term use.

Subscription plans, prices, and included features are described in the App and in the App Store product pages. We may add, change, or remove plans or features with notice where required by law.

3.2 Billing and Renewal

• Subscriptions are auto-renewable. Your subscription will renew automatically at the end of each period (month or year) unless you cancel before the end of the current period.

• Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

3.3 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Ebru and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. To request a refund, use Apple's "Report a Problem" or the refund flow in the App Store. We do not control Apple's refund decisions.

3.4 Access After Subscription Ends

When your Ebru Pro subscription expires or is cancelled, access to Pro features (such as saving to Photos) will end at the end of the paid period. Your existing saved artwork and data in the App will remain subject to these Terms and our Privacy Policy.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.

• Infringe or misuse the intellectual property or other rights of us or any third party.

• Transmit harmful, offensive, or illegal content, or use the App to harass or harm others.

• Reverse-engineer, decompile, or attempt to extract source code of the App (except as allowed by mandatory law).

• Circumvent or abuse subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your artwork: You keep ownership of the artwork you create in the App. By using the App, you grant us only the limited rights necessary to operate the App (e.g., storing and displaying your content on your device and, if you use them, optional cloud or sync features as described in the App and our Privacy Policy).

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/ebru/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, text, graphics, and "Ebru" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

We are not responsible for any loss of content (e.g., artwork) due to device failure, user action, or other causes. You are responsible for backing up your content as you see fit (e.g., saving to Photos or other storage when the App allows).

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App (including features and subscription offerings) from time to time. Where the law requires, we will notify you of material changes to the service or subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/ebru/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in Section 3.3.

For significant adverse changes to subscription or use rights, we will use reasonable means (e.g., in-app or email notice) to inform you when required by applicable law.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's subscription or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
