Earshot: AI Voice Recorder — Terms of Use

Earshot is a voice recording and note-taking application for iOS (iPhone and iPad) and its Apple Watch companion, offered by Cihat SALIK ("we," "us," or "our"). It records audio you choose to capture, transcribes it on your device, and writes a summary, decisions and action items from that transcript. Part of the App is free to use; the rest is unlocked by Earshot Pro. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Unlimited recording, unlimited transcription, full text search, marked moments, auto-pause zones and five summaries per calendar month. No account is required and there is no time limit on the free tier.

3.2 Plans

• Yearly: an auto-renewable subscription, with a one-week free trial shown before purchase.

• Lifetime: a non-consumable, one-time purchase. It is paid once and is not a subscription; nothing renews and nothing is billed again.

Either opens unlimited summaries, the evening recap, Ask your recordings, export to plain text and Markdown, and the Face ID lock. The exact contents of each plan are described in the App and on its App Store product page and may change as the App develops.

3.3 Billing and Renewal (subscription only)

• The yearly subscription renews automatically at the end of each period unless you cancel before the end of the current period.

• Payment is charged to your Apple Account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.4 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Earshot and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. Use Apple's "Report a Problem" page or the refund flow in the App Store. We do not control Apple's refund decisions.

3.5 Restore and Access After Pro Ends

The Lifetime purchase can be restored on your other devices signed in with the same Apple Account using Restore Purchases. When a subscription expires or is cancelled, access to the Pro features ends at the close of the paid period and the App returns to the free tier. Your recordings, transcripts and the summaries already written are not deleted and remain readable and searchable; new summaries return to the free monthly allowance.

You are responsible for recording lawfully. The law on recording conversations differs by country and, in some countries, by state: many places require everyone present to be aware of the recording, and some require the consent of every participant before you may record at all. Some settings — a classroom, a clinic, a courtroom, a workplace — have their own rules on top of that.

Before you record other people, find out what applies where you are, tell them you are recording, and stop when they ask you to. Do not use the App to record anyone covertly, to record a conversation you are not part of, or to record in a place where people reasonably expect privacy.

We provide a recording tool. We cannot know your circumstances, we do not advise on the law, and the responsibility for every recording you make is yours.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation, including the recording, wiretapping and data protection law that applies where you are.

• Infringe or misuse the intellectual property or other rights of us or any third party, including the rights of people whose voices you record.

• Use the App to harass, stalk, intimidate or harm anyone, or to record anyone covertly.

• Transmit harmful, offensive, or illegal content.

• Reverse-engineer, decompile, or attempt to extract source code of the App (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your content: You keep all rights you already hold in the audio you record and the transcripts, summaries and notes created from it. We claim no rights in them and we do not need a licence to them, because they stay on your devices.

On-device operation: Recording, transcription, summarisation, Ask, search and export all run on your device. Speech recognition uses the framework built into iOS; summaries, the evening recap and Ask use Apple Intelligence on devices that support it. The App contains no API key and sends nothing to a third-party AI service.

iCloud backup: Backup is off until you turn it on. When it is on, your data syncs through your own iCloud account between your devices and Apple. We operate no server and have no access to it.

Deletion: You can delete any recording, have the App delete audio automatically after a number of days and keep only the text, and lock the App behind Face ID or Touch ID.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/earshot/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, processing pipeline, prompts, text, graphics, and the "Earshot" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

Transcripts and summaries are produced automatically and will contain mistakes. Speech recognition misses words, mishears names, numbers and technical terms, and struggles with crosstalk, accents, background noise and poor microphone placement. A summary, a decision list or a set of action items is a model's reading of an imperfect transcript, not a record of what was said.

Do not rely on any of it as a verbatim record, as minutes of a meeting, as medical, legal or financial advice, or as evidence. Check anything that matters against the audio itself; every line carries a timecode so you can.

Summaries, the evening recap and Ask require a device that supports Apple Intelligence and that feature being available in your region and language. We do not guarantee that it will be available, that it will stay available, or that its output will be accurate, complete or suitable for any purpose.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

Recording depends on your device and on iOS. A call, a low battery, storage pressure, another app taking the microphone, or the system suspending a background recording can interrupt or end a recording in progress. Auto-pause zones depend on location accuracy and may trigger late or not at all.

We are not responsible for any loss of content (for example, audio, transcripts, summaries or notes) due to device failure, user action, or other causes, nor for anything missed because a recording did not run. You are responsible for backing up and exporting what matters to you.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it, including anything arising from a recording you made or from reliance on a transcript or summary.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App, its in-app purchases and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App from time to time, including its features and purchase options. Where required by law, we will notify you of material changes to the service or to subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/earshot/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in 3.4.

Features already unlocked by the Lifetime purchase remain unlocked; we will not move a previously purchased feature behind a new payment.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchase or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
