Afterglow: Long Exposure Cam — Terms of Use

Afterglow is a long exposure camera application for iOS (iPhone and iPad) offered by Cihat SALIK ("we," "us," or "our"). It builds a photograph from many live camera frames, blends them on your device, and lets you re-blend, grade and export the result. Part of the App is free to use; the rest is unlocked by Afterglow Pro. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Light Trails, Silky Water, Motion Blur and Fireworks, with no watermark and no limit on the number of photos you take, one grade in each of the six look families, and full-resolution HEIC and JPEG export. No account is required and there is no time limit on the free tier.

3.2 Plans

• Lifetime: a non-consumable, one-time purchase. It is paid once and is not a subscription; nothing renews and nothing is billed again.

• Annual: an auto-renewable subscription, with a one-week free trial shown before purchase.

Both support Family Sharing, and both open the remaining fourteen capture modes, re-blending after capture, the full grade library, RAW/DNG export, 4K timelapse video, the manual exposure panel and the Tonight planner. The exact contents of each plan are described in the App and on its App Store product page and may change as the App develops.

3.3 Billing and Renewal (subscription only)

• The annual subscription renews automatically at the end of each period unless you cancel before the end of the current period.

• Payment is charged to your Apple Account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.4 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Afterglow and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. Use Apple's "Report a Problem" page or the refund flow in the App Store. We do not control Apple's refund decisions.

3.5 Restore and Access After Pro Ends

The Lifetime purchase can be restored on your other devices signed in with the same Apple Account using Restore Purchases. When a subscription expires or is cancelled, access to the Pro features ends at the close of the paid period and the App returns to the free tier. Photos you have already exported are unaffected, and captures made with a Pro mode stay in your library and can still be viewed, graded with the free looks and exported at full resolution.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation, including the law on photographing people and private property where you are.

• Infringe or misuse the intellectual property or other rights of us or any third party.

• Photograph people in a place where they have a reasonable expectation of privacy, or use the App to harass, stalk or harm anyone.

• Transmit harmful, offensive, or illegal content.

• Reverse-engineer, decompile, or attempt to extract source code of the App or its blending and alignment pipeline (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your content: You own every photograph and video you make with the App, and you are free to use, publish and sell them. We claim no rights in them and we do not need a licence to them, because they stay on your device.

On-device operation: Frames are captured, aligned, blended, graded and exported on your device. The App asks only for permission to add photos to your library; it does not request read access and never scans or uploads your library.

Storage: Source frames are kept so a capture can be re-blended later, and they take real space. The App shows how much. Discarding the frames keeps the finished photo and frees the space, and that capture can then no longer be re-blended.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/afterglow/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, accumulation and alignment pipeline, blend modes, grade presets, text, graphics, and the "Afterglow" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

The grades shipped with the App may be applied freely to your own photographs. They may not be extracted, redistributed or resold as presets in their own right.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

A long exposure is a demanding capture. Results depend on your device, the light, the steadiness of the phone and the length of the exposure. Frame alignment is best-effort and will not rescue every handheld shot; thermal limits, low battery, an incoming call or iOS reclaiming memory can shorten or end a capture that is already running. Long captures warm the device and use the battery quickly.

The Tonight planner computes sun, moon and twilight times from your location on the device. Those figures are an astronomical estimate, not a weather forecast or a guarantee of visibility.

We are not responsible for any loss of content (for example, captures, frames or exports) due to device failure, user action, storage pressure, or other causes. You are responsible for exporting what matters to you.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App, its in-app purchases and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App from time to time, including its features and purchase options. Where required by law, we will notify you of material changes to the service or to subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/afterglow/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in 3.4.

Features already unlocked by the Lifetime purchase remain unlocked; we will not move a previously purchased feature behind a new payment.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchase or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
