Kanava: Cross Stitch Pattern — Terms of Use

Kanava is a counted-craft charting app for iOS (iPhone and iPad) offered by Cihat SALIK ("we," "us," or "our"). It converts a photo or a drawing into a counted chart for cross stitch, fuse beads, brick stitch and peyote, matches the colours to a floss palette, and exports the chart as a printable PDF, a PNG, or a DST or PES machine file. Part of the App is free to use; the rest is unlocked by a one-time purchase or an optional subscription. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age (or the minimum age required in your country to consent to use of the App) to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

3.1 What is free

Charts up to 10,000 stitches, up to 12 colours, a watermarked PNG preview and the Kanava project file are free, with no time limit and no account.

3.2 Plans

• Full version: a non-consumable one-time purchase. Paid once, it is not a subscription — nothing renews and nothing is billed again. A launch-price offer for the same unlock may be shown alongside it.

• Yearly: an auto-renewable subscription, offered as an alternative to the one-time purchase, with a free trial period shown before purchase.

Either unlocks the tiled PDF chart, the DST and PES machine files, unlimited colours, full-size charts, the thread box and the finish-date forecast. The exact contents of each plan are described in the App and on its App Store product page and may change as the App develops.

3.3 Billing and Renewal (subscription only)

• The subscription renews automatically at the end of each year unless you cancel before the end of the current period.

• Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

• Prices are in the currency of your App Store region and may change with notice to the extent allowed by Apple's policies and applicable law.

• Any free trial converts into a paid period unless cancelled at least 24 hours before it ends.

3.4 Cancellation and Refunds

• Cancellation: You may turn off auto-renewal at any time in your device Settings → [Your Name] → Subscriptions, then select Kanava and turn off renewal. Cancellation stops future charges but does not refund the current period.

• Refunds: Refund requests are handled by Apple, not by us. To request a refund, use Apple's "Report a Problem" or the refund flow in the App Store. We do not control Apple's refund decisions.

3.5 Restoring and Access After a Subscription Ends

The one-time purchase is non-consumable, so you can restore it on your other devices signed in with the same Apple ID using Restore Purchases. When a subscription expires or is cancelled, access to the unlocked features ends at the end of the paid period and the App returns to its free tier. Your existing charts, progress and prior exports are not deleted and remain usable; new charts and exports made after that point follow the free tier's limits.

You agree to use the App only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation.

• Infringe or misuse the intellectual property or other rights of us or any third party. You are responsible for holding the rights to any photo or artwork you convert into a chart, and for how you use, publish or sell the chart that results.

• Transmit harmful, offensive, or illegal content, or use the App to harass or harm others.

• Reverse-engineer, decompile, or attempt to extract source code of the App (except as allowed by mandatory law).

• Circumvent or abuse purchase, subscription, access control, or security features.

• Use the App to build a similar or competing product or service.

We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms.

Your charts: You keep ownership of the photos, drawings and charts you create in the App. We claim no rights in them and need no license to them, because they stay on your device.

On-device operation: Kanava reads only the photos you pick through the system picker, and charts, stores and exports your work on-device. We do not require an account and do not upload your photo library or your charts.

Diagnostics: On first launch only, the App sends a single anonymous message reporting your device model and name, iOS version, screen, hardware, locale, time zone and app version. Nothing about your photos, charts or usage is included, and nothing further is sent afterwards.

Privacy: Collection and use of your data are described in our Privacy Policy at https://apps.cihat.dev/kanava/privacy-policy/. By using the App, you also agree to that policy.

The App (including its design, code, charting engine, symbol set, text, graphics, and the "Kanava" name and branding) is owned by us or our licensors and is protected by copyright and other laws. These Terms do not grant you any right to our trademarks or other IP except the limited right to use the App as permitted here.

Thread and bead colour names, shade numbers and brand names shown in the App belong to their respective owners. Perler is a trademark of Simplicity Creative Corp., Hama is a trademark of Malte Haaning Plastic A/S, and DMC is a trademark of Dollfus-Mieg et Compagnie. Kanava is an independent app and is not affiliated with, endorsed, sponsored by or approved by any of them.

The App is provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, or fit for any particular purpose.

Colour matching, skein, bag and gram estimates, finished-size figures and finish-date forecasts are calculated guidance, not guarantees. Dye lots, fabric, bead stock and your own working style all vary; check the numbers against your materials before you buy or cut.

We are not responsible for any loss of content (for example, charts or exports) due to device failure, user action, or other causes. You are responsible for backing up your work as you see fit, for example by exporting a project file.

To the maximum extent permitted by applicable law:

• We (and our affiliates and suppliers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App or inability to use it.

• Our total liability for any claims arising from or related to the App or these Terms shall not exceed the amount you actually paid us for the App and subscriptions in the twelve (12) months before the claim (or, if no payment, zero).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent allowed by law.

We may update the App (including features and purchase offerings) from time to time. Where the law requires, we will notify you of material changes to the service or subscription terms.

We may change these Terms. We will post the updated Terms at https://apps.cihat.dev/kanava/terms-of-use/ and update the "Last updated" date. Your continued use of the App after the change constitutes acceptance. If you do not agree, you must stop using the App and may cancel your subscription as described in Section 3.4.

Your use of the App is also subject to Apple's applicable terms, including the App Store Terms of Use and the Apple Media Services Terms and Conditions, where relevant. In case of conflict between those and these Terms regarding the App's purchases or use, these Terms govern the relationship between you and us; Apple's terms govern your relationship with Apple.

These Terms are governed by the laws of Turkey, without regard to conflict-of-law rules. Any dispute arising from or related to the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, to the extent permitted by law.

Entire agreement: These Terms (together with our Privacy Policy and any in-app terms we expressly reference) constitute the entire agreement between you and us regarding the App.

Severability: If any part of these Terms is held invalid or unenforceable, the rest remains in effect.

No waiver: Our failure to enforce any right or provision does not waive that right or provision.
